The War on Drugs is more accurately known as the War on the Bill of Rights because it has done far more to destroy that hallowed quintessentially American document and the fundamental precepts of law behind it than it has to stop Americans' access to drugs. There is little left of the guarantees of the Fourth and Fifth Amendments, and the Second and First are on their way to oblivion. And let us note the poor pathetic remnant of the 10th Amendment with a moment of silence...The fact is, the United States has become a monarchy, if an elective monarchy...
So let us face the fact, and admit the reality. Since the Congress is but a useless appendix of power, let us excise it, let us abolish it, before it inflames itself and ruptures fatally...
And, of course, let the measure be done in the manner most appropriate -- by executive order.
Cato Institute - When Judges Overreach. Apparently trial judges are starting to notice that jurors are becoming more knowledgeable about their right to judge the law as well as the alleged law-breaker. One judge dismissed a juror who didn't like the law, and the resulting conviction is now in appeal to the state supreme court. Good. Jury nullification is one good way to control a legislature that routinely ignores the constitution.
